Terms of Service

By accessing or using Voxlair ("the platform", "we", "us"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Content Policy.

If you do not agree to these Terms, do not create an account and do not use the platform.

We may update these Terms from time to time. When we make material changes, we will update the effective date. Your continued use of Voxlair after the updated effective date constitutes acceptance of the revised Terms. If you disagree with a change, you must stop using the platform and delete your account.

You may use Voxlair only if:

• You are at least 13 years old. If you are under 18, you must have obtained parental or guardian consent.
• You are not prohibited from using the platform under applicable law — for example, if you are on a sanctions list or are subject to a court order that prevents it.
• You have not previously been permanently banned from Voxlair.
• You are not creating an account solely to evade an existing ban.

By creating an account, you represent and warrant that you meet all eligibility requirements. We may terminate accounts that we reasonably believe are held by ineligible users.

By posting User Content on Voxlair, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable licence to:

• Store, reproduce, and display your User Content on the platform.
• Format and reformat your User Content for display across different devices and layouts.
• Generate preview text and metadata from your User Content for sharing and indexing purposes.
• Retain your User Content for the periods described in the Privacy Policy.

This licence is limited to operating and improving Voxlair. We do not licence your User Content to advertisers or sell it to third parties. The licence terminates when you delete the content or your account, subject to the retention periods in the Privacy Policy.

No AI training: We do not licence your User Content for training machine learning or artificial intelligence models, and we will not do so without your explicit opt-in consent.

In addition to the Content Policy, you agree not to:

• Access or attempt to access accounts, systems, or data that do not belong to you.
• Reverse-engineer, decompile, or attempt to extract the source code of the platform.
• Use automated scripts, bots, or crawlers to scrape or interact with the platform without our written permission.
• Deliberately overload, attack, or disrupt the platform or its infrastructure.
• Circumvent any rate limits, access controls, or security measures.
• Create accounts to evade a ban or other moderation action.
• Sell, trade, or transfer your account to another person.
• Use the platform to harvest or compile contact information about other users.
• Represent yourself as a Voxlair employee, moderator, or administrator.
• Manipulate voting through coordinated upvote/downvote rings or vote-buying.
• Post referral links, affiliate links, or spam in contexts where they are not welcome.

We reserve the right to remove content, issue warnings, apply temporary bans, or permanently ban accounts that violate these Terms or our Content Policy. We may act without prior notice.

Moderation decisions are described in full in our Content Policy. Most actions (post removal, warnings, temporary bans) can be appealed by full account holders. Permanent bans for Tier 1 violations cannot be appealed.

We are not obligated to moderate every piece of content. By using Voxlair, you acknowledge that you may encounter content posted by other users that you find offensive, inaccurate, or objectionable. Your recourse is the flagging system.

If you believe content on Voxlair infringes your copyright, send a written notice to contact@voxlair.com containing:

• Identification of the copyrighted work you believe is infringed.
• Identification of the infringing content (post URL, comment ID).
• Your contact information (name, address, email, phone).
• A statement that you have a good-faith belief that the use is not authorised.
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.
• Your signature (electronic is acceptable).

We will investigate valid DMCA notices and remove infringing content within a reasonable time. Repeat infringers will have their accounts terminated.

Counter-notices may be submitted by the content poster. We will restore content after 10 business days if the original complainant does not file a court action.

Voxlair is provided on an "as is" and "as available" basis. We do not guarantee:

• Continuous, uninterrupted, or error-free availability.
• That the platform will be available in your jurisdiction.
• That any particular feature will remain available indefinitely.
• That data stored on the platform will never be lost (maintain your own backups of content you care about).

We may modify, suspend, or discontinue any part of the platform at any time, with or without notice. We are not liable for any consequences of such modifications.

To the fullest extent permitted by applicable law:

• Voxlair is provided 'as is' and 'as available' without warranty of any kind, express or implied.
• We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the platform is free of viruses or other harmful components.
• We are not responsible for the accuracy, reliability, or legality of User Content posted by third parties.
• We do not endorse any opinion, advice, or statement posted by users.

To the fullest extent permitted by applicable law, Voxlair and its operators, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or other intangible losses.
• Damages resulting from your access to or inability to access the platform.
• Damages resulting from content posted by other users.
• Damages resulting from any unauthorised access to or alteration of your account or content.

Our total aggregate liability for all claims arising out of or relating to these Terms or your use of the platform shall not exceed INR 1,000 (one thousand Indian rupees) or the amount you paid us in the 12 months preceding the claim, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Voxlair and its operators, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected to:

• Your access to or use of the platform.
• Your User Content.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Any claim that your User Content caused damage to a third party.

These Terms are governed by and construed in accordance with the laws of India, including but not limited to:

• The Information Technology Act, 2000 and its rules and amendments.
• The Digital Personal Data Protection Act, 2023.
• The Indian Contract Act, 1872.
• The Copyright Act, 1957.

The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
